With the widespread adoption of mandatory mediation as a precondition to litigation in Türkiye, the need has arisen to define areas of specialization according to the type of dispute in order to further develop mediation. Article 6 of Law No. 6325 on Mediation in Civil Disputes authorizes the Department of Mediation to determine the areas of specialization in mediation and the procedures and principles governing such specialization. Within the scope of this authority, Health Law has been designated as a special area of expertise, and the procedures and principles for specialized mediation training in Health Law have been established by the Department of Mediation. Principles Regarding the Trainers of the Training Program
Our theoretical training provides the fundamental knowledge of health law required for specialized mediation in health law, as well astechnical knowledge and skills. In addition to the topics in the program, primarily health literacy and the legal approach to health law disputes, it covers mediation-related subjects such as the communication skills required by the field of expertise, negotiation methods, meeting management, conflict analysis, methods applied in dispute resolution, the mediation process and the ethical rules to be observed in mediation.
Our practical training includes sample dispute resolution exercises and practical activities that enable prospective health law specialist mediators to develop their skills in using systematic techniques both individually and in groups. It involves each participating mediator practicing in the role of mediator, mediators taking part in dispute scenarios as parties or party representatives, practical exercises to develop their mediation skills, and activities related to drafting the minutes of the mediation process, particularly the final minutes. Practical Training sessions are delivered with two expert trainers.
Considering that this comprehensive training program covers both theoretical and practical training and requires a particularly interdisciplinary approach, our trainers are competent academics and practitioners selected from different fields of expertise.
Our training staff includes:Faculty members from various departments of Faculties of Law,Faculty members from the Departments of “Forensic Medicine” and “History of Medicine and Ethics” of the Faculty of Medicine,Faculty members from the Department of Health Management of the Faculty of Health Sciences, as well asAn internationally active expert negotiator, specialist physician mediators holding undergraduate degrees from both a faculty of medicine and a faculty of law, and experienced mediators who are experts in their fields.
